Welcome to ML Shop ("Company", "we", "our", "us").

The following Terms and Conditions of ML SHOP explains the “terms of use” of these website and app.

Please read these carefully before placing an order from any products of these Website and app. Your access to and use of the Website is a conditioned on your acceptance of and compliance with these Terms of use.

  1. Our Website

    2. ML SHOP is an online services operated by M Lhuillier Financial Services Inc. with the official address at ML Bldg. B. Benedicto St. North Reclamation Area Cebu City, Cebu.

    3. For all inquires relating to these Terms of Use, the products, the orders you may contact our customer Service in the “Contact us” section of the Website or App.

  3. Change of Service

    4. We have the right to change and update these Terms at any time. In every change that we have made in the Terms of use on the website, we will post it with an indication of the last updated date.

  4. Amendments to Terms

    5. We may amend Terms at any time by posting the amended term on this site.It is your responsibility to review these Terms periodically. You continued use of the Platform following the posting of the revised Terms means that you accept and agree to the changes.

  5. No use by Minors

    6. Service is intended only for access and use by individuals at least eighteen (18) years old.

  6. Intellectual Property Rights

    7. Service and its original content (illustrations, photographs, video, audio or any graphics), features and functionality are will remain the exclusive property of ML Shop or its licensors. Services is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks marks may not be used in connection with any products or service without the prior written consent of ML SHOP.

  7. Registration of Account

    8. If you wish to avail any products on ML Shop. You need to download the ML Wallet/MCash application and register for an account. You may also see Privacy Policy on its app.

    When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times.

  8. Purchase and Payment
    1. If you wish to proceed in placing an order on the products that you like, you may asked to supply your ML Wallet/MCash account and other shipment information. You will also then shown on the site the charges you must pay including Value added Tax (VAT), and any applicable delivery charges stated in Philippines peso currency.
    2. For non ML Wallet/MCash Users you must first register in accordance to clause 7.
    3. You undertake that all details you provide upon placing an order is correct, and the payment method which you use is your own, and that there are sufficient funds to cover the cost of the product.
    4. We reserve the right to obtain validation of your payment details before providing you with the products.
    5. The Order shall be considered accepted when you receive an order confirmation through messages or email with an order reference number and the products details that you have ordered.
    6. We reserve the right to refuse or cancel your order if fraud, unauthorized or illegal transaction is suspected.
    7. If ever there is a mistake you have made to your order after you have received the order confirmation, you have to contact immediately our customer care or via email. But, we cannot guarantee that we will be able to amend your order in accordance to with the instructions.
    8. We try to ensure that the price of the products we offered on our website is precise. Still, we do not warrant that the pricing is always correct. On condition that the price of the products that you have ordered is mistaken. We may, at our discretion, decide to cancel your order, whether before or after order confirmation. When it goes, we will notify you via e-mail or contacts. If your payment has been completed, we will ensure that you are refunded the full amount of what you have paid, in-accordance with timeline outlines in our Refund Policy.

  10. Return Policy

    11. We may only accept refund /return of the following circumstances:

    1. The item was defective and/or damaged during in-transit.
    2. The item delivered to buyer does not match from the description provided by Seller in the listing of the Item. (e.g. wrong karat) to Buyer.
    3. The Item delivered to Buyer is materially different from the description provided by Seller in the listing of the Item.
  11. Process for Return
    1. Buyers will have 3 days to file for Return/Refund from the date the item was received. Late filing of return/ refund will not be accepted. On the other hand, the item is considered to be in good condition.
    2. Buyers may also contact our customer care for assistance and further information.
    3. After confirming your request for return, you may now go to the nearest or pick-up branches to drop off the package. Please pack the item(s) properly to its original packaging with all accessories must be intact. Official Receipt must also be attached in the package.
  12. Process for Refund
    1. Once we receive your item, we will make an inspection and we will notify you that we have received the returned item. We will immediately notify you on the status of your refund after inspecting the item.
    2. On condition that return is approved, we will initiate a reload to your ML wallet/MCash Account as the only mode of payment.
    3. Shipping fee is not refundable if item was shipped and received by the customer.
    4. However shipping fee is refundable if the seller has failed to ship the item for the reason;
      1. Order has been canceled in accordance to clause 8 #8.6
      2. Order has been failed to process by the Seller from the allotted time frame.
    5. The returns will be made at your own cost.
    6. Please expect the maximum time frame for the refund is within 30 days.
    7. ML Shop encourages customers to communicate with each other in the event where problem arises in a transaction. Customers should contact the Seller directly for any issue relating to the Item purchased.
  13. No Exchange Policy

    14. Unless stated in this Refunds and Return Policy, Buyer may not apply for the return of the Item and/or refund due to a change of mind.

  14. Termination

    15. We may terminate or suspend your access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

  15. Governing Law

    16. These Terms shall be governed and construed in accordance with the laws of Philippines, which governing law applies to agreement without regard to its conflict of law provisions.

    Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or enforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.
